NEXELLENCE offers you the opportunity to participate in various voting and survey events by means of SMS text messages.

To participate in these diverse events, the text messages should be sent following the sample instructions below:

Voting

Send your vote to the number XXXXX

EXAMPLE: To vote for your favorite Reggaeton artist: 1. Don Omar, 2. Daddy Yankee, 3. Calle 13, you should send your preference preceded by the word "vota”.

If your preference is Don Omar, you can vote by texting: "vota 1"; or "vota Don Omar"; or "vota Don".

The text messages with your vote should be sent to the number XXXXX, a special number of only 5 figures to facilitate your participation. You will receive the updated voting results after you have sent in your vote through a text message.

This service has a cost usually of $0, 50 per vote, charge which will appear in your cellular phone bill. Other charges could be charged as shown in the contest rules posted in media services.

NEWS ALERTS

NEXELLENCE provides the technology and the capacity to develop news alert events with text content as well as images, audio, and video. For example, Televicentro of PR presently offers its viewers the choice of receiving alerts with news, sports, weather, entertainment, and others by means of subscription through SMS text messages in their cellular phones.

Wapa Alerts – Sample

WAPA offers you the opportunity to receive various alerts with news, sports, events, entertainment, concerts, etc. by means of subscription.

For news alerts, the text messages usually should be sent following the following sample instructions:

Alert Subscriptions

Subscribe to receive your favorite alerts with the number assigned in the media: XXXXX

EXAMPLE: To subscribe to receive daily alerts with news, you should send a text message to XXXXXX with the keyword “WAPA ALERTAS”.

You will receive a confirmation message to which you should answer affirmatively to assure your monthly subscription to the news alerts. Once subscribed, you will receive daily alerts. This subscription usually has a cost of $1, 99 monthly, charge which will appear in your cellular phone bill. Other charges could be charged as shown in the instructions posted in media services.

To cancel your subscription, you can do so at any time by sending a text message to XXXXX with the keyword: “NO WAPA ALERTAS”.

“On Demand” News Alerts

You can request the last news alert by texting the assigned number that appears in the media: XXXXX

EXAMPLE: To receive your news alert, you should send a text message to XXXXX with the keyword "ALERTA NOTICIAS".

You will receive a confirmation message to which should answer affirmatively to assure your alert. Once sent, you will receive your alert within the next few minutes. This service has a cost of $0, 99 per alert, charge which will appear in your cellular phone bill.

PERSONAL MESSAGES IN TELEVISION - TEXT-to-TV

You can participate in various events in which you can send your personal messages that can be shared with the TV viewers. You can send personal messages and/or opinions so that all of Puerto Rico can read them through TV programs at all hours of the day and night. An example of this is it MTV-PR.

You only have to text the number assigned in the media XXXXX from your mobile telephone and include your message. You can submit as many messages as you desire at any hour of the day or night. You must be on the alert for when message is posted on the TV program that you participated in, following the instructions posted in the media.

This service has a cost of $0, 50 per message, charge which will appear in your cellular phone bill. Other charges could be charged as shown in the instructions posted in media services. Other of interconnection costs could apply according to the service that you have agreed to with your cellular phone company.

To send a text message from your cellular phone for the event desired, follow these steps:

1. In your cellular phone, selects Menu -> Messages -> Write message
2.Write your vote or comment (i.e.: FS I want you to play more videos)
3.Select Options, and then Send
4.When the system asks for the telephone number, text XXXXX
5.Selects Send again
6.You will receive a confirmation message that your message has been received.

2.       WHO CAN PARTICIPATE?

Depending on the event, mostly clients of the following cell companies:

- T Mobile
- Centennial
- AT&T
- Claro
- Open Mobile.
-Sprint

3.      I HAVE A PREPAID TELEPHONE, ¿CAN I SEND MY MESSAGES?

Some cellular companies do not allow clients prepaid customers to participate in text messaging services. If your cellular phone company has blocked this service in your telephone, you will receive a message saying that you cannot participate.

4.       WHEN I TRY TO SEND AN SMS, I RECEIVE A MESSAGE THAT SAYS "MESSAGE CANNOT BE SENT". WHY?

This is because your cellular phone company still does not allow for text messaging for the event. Your cellular phone company may have the text messaging service blocked on your telephone or because you find yourself in an area with poor cellular coverage. Contact your cellular company for more information.

5.       HOW MUCH DOES IT COST TO PARTICIPATE?

There is a non refundable charge for each event according to the instructions posted in the media. The charge will appear in your cellular phone bill; and, depending on your cellular plan, you could be charged a regular fee for the text messaging service. Please verify your cellular plan coverage for more information.

Terms and Conditions

1.- Participating Cellular Phone Companies

T Mobile, Centennial, AT&T, Verizon Wireless, Open Mobile and Sprint clients that have cellular telephones with the capacity to send SMS messages can utilize the audience participation services by means of SMS messages offered by NEXELLENCE. We are working to expand the number of participating cellular phone companies. If your cellular phone company is not one of the previous listed, please check the media or visit the web page, where we will be posting the new participating cellular phone companies that we continue adding to the list.

2.- Exclusion of responsibility

2.1. – Regarding sending and receiving of messages

The sent messages should follow the established instructions to that effect. NEXELLENCE is not responsible for the messages that are not accepted by the data processing platform that receives them, provided that this is due to reasons that are not under NEXELLENCE control (i.e.: failures in connectivity or network malfunction, errors in the wording of the messages, etc.).

NEXELLENCE is not responsible for the delays that can occur in the sending of messages, or with their quality, since these issues depend solely on factors that are not under NEXELLENCE control, such as the network traffic, etc. Nevertheless, NEXELLENCE will carry out every reasonably possible effort so that the messages arrive at our platforms and they are adequately processed.

Regarding text messages, NEXELLENCE does not guarantee that all the messages received are processed. The number of messages processed will depend on the number of messages received, the time assigned for processing and other event demands. Messages with obscene, offensive, illegitimate or illegal content will be filtered and eliminated.

Regarding the content of the text messages, NEXELLENCE and its business associates are not responsible for the content of the messages. The responsibility of the content of the text messages will rely solely on the users who send the messages. NEXELLENCE and its business associates will apply all available measures to avoid non appropriate content in the text messages.

2.2. - By the ownership of the mobile device

NEXELLENCE is not responsible in the case that the person that sends the messages is not the legitimate owner of the mobile device from which the messages are sent.

3. - Price for the services

The prices for the participation services by means of SMS offered by NEXELLENCE will be the prices reported in the media for each event. These prices will be invoiced and charged by the cellular telephone company through the cellular account of the telephone owner from which the SMS text message is generated. Standard costs, in addition to the cost of participating in the event, could apply as stated in the agreed terms between the user and their cellular telephone company.
